Biography

Gregory R. Lyman was born in Flint, Michigan. He received his undergraduate degree from Michigan State University magna cum laude and his law degree with highest distinction from the Valparaiso University School of Law in 1977. Mr. Lyman has served as adjunct faculty member at the Valparaiso University School of Law. He is active in numerous bar and community activities and has been a panelist on a number of conferences related to employment and personnel issues. His primary areas of practice include employee benefits, employment law and labor law. He is admitted to practice in the Indiana Courts, various federal district courts, the Seventh Circuit Court of Appeals and the United States Supreme Court. He has practiced before numerous federal and state agencies. He has handled appeals and argued before courts in both Indiana and the federal courts.

Employee Benefits. Greg counsels employers in all phases of designing, implementing, administering and terminating employee benefit and retirement plans, including: pension and profit-sharing plans, 401(k) plans, non-qualified deferred compensation and employer stock arrangements. He has secured IRS approval for the Burke Costanza & Carberry Volume Submitter profit sharing and 401(k) plan which has been adopted by numerous employers. (A Volume Submitter Plan contains more flexibility or options than a prototype and can be tailored for an employer’s needs.) He provides consultation on ERISA compliance issues and regularly represents clients in IRS and DOL audits and compliance matters. He advises clients on employee benefit and employment issues in business transactions such as stock sales and asset purchase sales.

Greg also has extensive experience in drafting and advising employers on health and welfare plans including: self funded health plans, health reimbursement plans, HSA plans, cafeteria plans and other fringe benefits programs. He regularly consults with clients on COBRA and other compliance issues. Greg also has represented not-for profit entities and has advised and drafted plans specific to the needs of these entities such as 403(b) plans and 457 deferred compensation plans. 

Employment.  Greg has over 40 years of experience handling all facets of employment issues and advising employers concerning Federal and Indiana laws and regulations impacting employment. He has appeared before federal and state courts, agencies, handled DOL audits and EEOC investigations concerning employment practices. He assists employers with self audits to determine and correct compliance issues. He regularly consults with employers on personnel, human relations issues, drafts employee manuals and other employment policies.  He has advised clients on leasing, independent contractor and joint employer issues, multiple employer issues including PEO (professional employer organizations).

Labor.  Greg has over 33 years of experience representing management in union labor issues including union organizing issues, advising and negotiating collective bargaining contracts, handling investigations before the NLRB, advising and handling grievance procedures and arbitrations and multi-employer pension and health and welfare issues.
