Attorney Kevin Steele obtained a decision from the Indiana Court of Appeals affirming the trial court’s judgment against a delinquent tenant and remanding the case for further determination of appellate attorney fees. The Court of Appeals upheld the trial court’s reformation of the assignment document to reflect the correct Ten-Year Lease, as the evidence at trial proved a five-year lease was mistakenly attached to sale documents and did not align with the parties’ intentions. The court also upheld the award of damages to the firm’s clients, finding no error in the trial court’s handling of mitigation or the damages calculation. Additionally, the court determined that the trial court did not abuse its discretion in awarding attorneys’ fees to the landlords, as the ten-year lease provided for such fees. Lastly, the appellate court instructed the trial court to assess whether the landlords are entitled to appellate attorney fees.
